These terms and conditions apply to customers placing advertisements within News International digital products and services under negotiated terms and are to be read in conjunction with the Standard Terms and Conditions.
Any stipulation or condition applying to your order must be
clearly incorporated in the Insertion Order supplied to us, and
approved by us.
Orders for insertion of any advertisement are accepted on condition
that you grant the right to publish the advertisement in the
newspapers published by us and in any other of our publications
(including reprographic and digital cuttings and page images) in
any medium, whatever the means or system of production delivery
(including online versions of the newspapers).
We reserve the right at our discretion to decline to publish, or to
omit, suspend or change the position of, the whole or part of any
advertisement otherwise accepted by us for placement.
Our liability for any loss or damage resulting from errors or
inaccuracies in the reproduction of, delivery of, or omission of
the whole or part of, any advertisement is limited as set out in
paragraph 14 of the full Advertising Terms and Conditions.
You warrant to us that your advertisement will not breach any
contract or infringe any copyright, trademark or any other right of
any third party or render us liable to any claim or proceedings
whatsoever.
You will indemnify us and any publisher of an advertisement and
agree to keep us and any such publisher indemnified against all
claims, costs, proceedings, demands, losses, damages, expenses or
liability whatsoever arising directly or indirectly as a result of
any breach or non-performance of any of the representations,
warranties or other terms herein contained, set out in the terms
and conditions for advertising or implied by law.
All prices quoted by us are exclusive of VAT. Payments are due in
accordance with standard invoice terms unless otherwise agreed in
this Insertion Order. Invoices will be sent at End-of-Campaign
unless otherwise agreed.
Specifically for Classified Advertising, unless otherwise agreed,
premium advertisements are displayed for 7 days, buttons and top
leader boards are displayed for 28 days. Premium position and
leader board advertisements will be in rotation with no more than 7
other advertisers.
Booking and Copy Deadlines: Unless otherwise agreed the deadlines
for receipt of all bookings and copy is as set out below. Insertion
Orders must be received by midday on Day One Insertion Orders
received after the deadlines may be accepted but original launch
date cannot be guaranteed. For the purpose of inventory management
Campaign-Start-Date will remain as scheduled.
Non-Dart served, Features, Micro sites and bespoke advertising are
managed by prior agreement.
The above deadlines are the shortest acceptable period, please note
that some advertisements may take up to one month to deliver.
Change requests or extensions to an end date for a campaign may be
submitted at any point. However, a new IO must be submitted and may
result in amendments to campaign dates. We cannot guarantee the
positions, dates or times of advertisements, however, we will use
our reasonable endeavours to comply with your requests.
You agree that usage statistics provided by us using DFP stats are
the official measurements of our performance and will always be
considered final. Usage statistics include but are not limited to
click-through or impressions for any placement. Notwithstanding the
provisions of any Insertion Order you acknowledge that we make no
guarantees with respect to usage statistics.
Cancellation or amendment of any booking cannot be accepted less
than 14 days prior to the launch date as specified on the IO in
respect of run of site campaigns, and 28 days prior to the launch
date specified on the IO in respect of orders for capped, targeted
or fixed placements
The supply of creative artwork and links in accordance with NI
published deadlines is the responsibility of the Advertiser. Late
copy may impact on the inventory made available to ensure that your
campaign is fulfilled. In line with IAB standards on late copy
delivery, a pro-rata reduction of total amount inventory requested
in your Insertion Order will be applied and you will be charged in
full.
All creative and design charges are the responsibility of the
advertiser unless otherwise agreed and clearly stated on the signed
insertion order.
